1. Introduction

Welcome to MarriageShadi.com ("MarriageShadi", "we", "us" or "our").

These Terms and Conditions govern your access to and use of MarriageShadi.com, including matrimonial profiles, search and matching features, private messaging, identity or profile verification, paid memberships and any other services provided through the platform.

By creating an account, purchasing a membership or using MarriageShadi.com, you agree to these Terms and Conditions and our Privacy Policy. If you do not agree with these Terms, you must not use MarriageShadi.com.

MarriageShadi.com is operated by a company registered in New Zealand.

2. Eligibility

You may only use MarriageShadi.com if:

• you are at least 20 years old;
• you are legally eligible to marry under the laws applicable to you;
• you have the legal capacity to enter into an agreement;
• you are genuinely seeking a marriage partner or assisting an adult family member with their permission;
• you are not prohibited by law from using our services; and
• your account has not previously been permanently removed by us.

MarriageShadi.com is intended for genuine matrimonial purposes and must not be used for casual dating, commercial solicitation, escort services or unlawful activity. We may request evidence of your age, identity or eligibility at any time.

3. Creating an Account

You must provide accurate, current and complete information when creating and maintaining your account. You agree to:

• keep your profile information updated;
• protect your password and login details;
• not impersonate another person;
• not create false, misleading or duplicate profiles;
• not use another person's photographs without permission; and
• notify us if you believe your account has been accessed without permission.

You are responsible for activity carried out through your account. We may refuse, restrict or remove an account if information appears false, misleading, incomplete or unverifiable.

4. Profiles Created by Family Members

A parent, relative or authorised representative may assist an adult in creating or managing a matrimonial profile where permitted. The person creating the profile confirms that:

• the person represented is at least 20 years old;
• they know about the profile;
• they have agreed to the profile being created;
• photographs and information are provided with permission; and
• they are genuinely seeking marriage.

We may require direct confirmation from the person represented in the profile.

5. Profile Information

You are responsible for all information, photographs and other content you provide. Profile information must not materially misrepresent matters including identity, age, gender, marital status, religion, caste, ethnicity or community, education, occupation, income, family background, immigration or residency status, photographs or matrimonial intentions.

You must update important information if your circumstances change. MarriageShadi.com does not guarantee that information provided by another member is accurate, complete or current.

6. Identity and Profile Verification

MarriageShadi.com may offer or require identity, age, photograph, telephone, email or profile verification. Verification may involve identification documents, photographs or selfies, video verification, proof of address, telephone or email confirmation, or third-party verification services.

A verification badge or status only confirms that certain information was checked at a particular time. Verification does not guarantee a member's honesty, character, financial position, immigration status, criminal history, compatibility, safety or suitability for marriage. Members remain responsible for carrying out their own checks and exercising appropriate judgement.

7. Memberships and Paid Services

MarriageShadi.com may offer free and paid memberships. Paid features may include additional profile access, messaging features, advanced search filters, increased profile visibility, contact features, photograph controls, verification features and other premium services.

The price, duration, currency and features of each membership will be displayed before purchase. We may change future membership prices or features at any time.

8. Payments

MarriageShadi.com accepts payment by credit or debit card through an authorised third-party payment provider. By making a payment, you confirm that:

• you are authorised to use the payment method;
• the billing information provided is accurate;
• sufficient funds or credit are available; and
• you authorise payment of the amount shown at checkout.

We generally do not store your full card number or card security code. Payment processing may also be subject to the terms and privacy policy of the relevant payment provider.

9. Manual Membership Renewal

MarriageShadi.com memberships do not automatically renew. When your paid membership expires:

• paid features may stop;
• your account may return to a free membership, where available; and
• you must manually purchase another membership if you wish to continue using paid features.

You will not be charged for another membership period unless you actively make another purchase. We may send membership expiry reminders but do not guarantee that a reminder will always be received.

10. Cancellation Policy

You may stop using or cancel your membership at any time through your account settings, where available, or by contacting Marriageshadi143@gmail.com.

Because memberships renew manually, cancelling your membership does not involve cancelling future automatic payments. Unless required by applicable law:

• cancellation does not result in a refund;
• no credit is provided for unused membership time; and
• paid access may continue until the membership expiry date.

If you voluntarily delete your account before your membership expires, any remaining membership period may be lost without refund.

11. Refund Policy

All membership purchases are generally final and non-refundable once payment has been completed and access to the paid service has been provided.

Refunds or credits will not normally be provided because:

• you changed your mind;
• you stopped using the service;
• you found a partner before your membership expired;
• you did not receive enough matches, messages or responses;
• another member did not respond;
• you are dissatisfied with another member;
• you did not use the membership;
• you deleted your account;
• your personal circumstances changed; or
• your account was suspended because you breached these Terms.

Purchasing a membership does not guarantee a specific number of matches, responses from other members, compatibility, a meeting, an engagement, a marriage or any particular relationship outcome.

If a significant technical issue caused by MarriageShadi.com prevents access to paid services, we may first attempt to restore access, correct the issue or extend the membership period. Refunds will only be provided where required by applicable law or where MarriageShadi.com determines that a refund is appropriate. Nothing in this Refund Policy limits any refund or consumer rights that cannot legally be excluded under applicable law.

12. Chargebacks and Payment Disputes

We encourage members to contact us before initiating a chargeback so we have an opportunity to investigate the matter. Members must not submit false, misleading or fraudulent chargebacks. We may restrict or suspend an account while a payment dispute is being investigated. This section does not prevent you from exercising legitimate rights provided by your bank, card issuer or applicable law.

13. Acceptable Use

You must use MarriageShadi.com honestly, respectfully and lawfully. You must not:

• impersonate another person;
• create fake or misleading profiles;
• upload photographs without permission;
• harass, threaten, stalk or abuse another member;
• engage in discrimination, hate speech or abusive conduct;
• send sexually explicit or unlawful content;
• engage in romance scams or financial fraud;
• request money, banking details or security codes;
• advertise unrelated businesses or services;
• send spam or repeated unwanted messages;
• collect member information for marketing;
• scrape or automatically copy profiles;
• introduce viruses, malware or harmful code;
• attempt unauthorised access to accounts or systems;
• manipulate verification or reporting systems;
• use the platform for trafficking, exploitation or illegal immigration arrangements;
• arrange or promote forced or unlawful marriage;
• facilitate marriage involving anyone under 18; or
• otherwise use the platform unlawfully.

We may investigate suspected misuse and take action without prior notice where reasonably necessary.

14. Messages and Communications

Private messaging is provided to help members communicate regarding genuine matrimonial interest. You are responsible for the messages and attachments you send.

You must not send abusive or threatening communications, obscene or illegal content, scams or fraudulent requests, malicious links or files, spam, another person's confidential information without permission, or content that violates another person's rights.

Although messages are not publicly displayed, MarriageShadi.com may review communications where reasonably necessary to investigate scams or fraud, harassment or abuse, member safety concerns, complaints, prohibited content, legal requests or breaches of these Terms. We may also use automated systems to detect suspected spam, scams or harmful activity.

15. Chat Records for Immigration or Legal Purposes

Members may request a copy of their chat records for legitimate purposes such as immigration, visa applications, court proceedings or other legal matters, with both users' approvals.

Requests must be made to Marriageshadi143@gmail.com and may require identity verification and relevant account or conversation details.

A service or administration fee will apply for retrieving, preparing, formatting or providing chat records. Any applicable fee will be advised before the request is processed.

Records will only be provided where they are available and where disclosure is permitted by applicable privacy and other laws. Information may be withheld or redacted where necessary to protect another person's privacy or comply with legal requirements. MarriageShadi.com does not guarantee that chat records will be accepted by Immigration New Zealand, another immigration authority, court or government agency. Nothing in this section limits a member's statutory rights to access their personal information under applicable privacy laws.

16. Member Safety

MarriageShadi.com is a matrimonial communication and matchmaking platform. We are not a marriage broker, immigration adviser, background-check agency, relationship counsellor or guarantor of member conduct.

MarriageShadi.com cannot guarantee the identity of every member, the accuracy of every profile, another person's intentions, compatibility, financial status, employment, immigration status, criminal history, family information, health information, or the success or safety of any relationship.

Members should take reasonable precautions before sharing personal information or meeting another member. You should never send money, passwords, banking information or authentication codes to another member. You are responsible for deciding whether to communicate with, meet or enter into a relationship with another member.

17. Meetings and Relationships Between Members

MarriageShadi.com is not a party to communications, meetings, engagements, marriages, financial arrangements or disputes between members. Any interaction with another member is undertaken at your own judgement and risk.

To the fullest extent permitted by law, MarriageShadi.com is not responsible for statements made by another member, another member failing to attend a meeting, relationship disputes, emotional distress caused by another member, engagement or wedding expenses, gifts or money exchanged between members, immigration or visa arrangements, family disagreements, financial losses or the actions of another member. Nothing in this section excludes liability that cannot legally be excluded.

18. User Content

You retain ownership of photographs, profile information, messages and other content you provide.

By submitting content to MarriageShadi.com, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display and process that content as reasonably necessary to operate the platform, display your profile, provide matchmaking and communication services, moderate content, protect platform security and enforce these Terms.

You confirm that you own or have permission to use the content you submit and that it does not violate another person's rights.

19. Content Removal

MarriageShadi.com may remove or restrict content that we reasonably believe is false or misleading, violates these Terms, infringes another person's rights, creates a safety risk, contains prohibited or unlawful material, is fraudulent or abusive, or may damage the integrity of the platform. We are not required to review every profile, photograph or message before it is published or sent.

20. Reporting Members

Members may report suspected fraud, harassment, fake profiles, abusive behaviour or other concerns through the platform or by contacting Marriageshadi143@gmail.com.

Reports must be made honestly and in good faith. We may investigate reports, request further information, restrict accounts, remove content or refer serious matters to relevant authorities. For privacy, safety or legal reasons, we may not be able to disclose the outcome of an investigation.

21. Suspension and Termination

MarriageShadi.com may warn, restrict, suspend or permanently terminate an account where we reasonably believe:

• these Terms have been breached;
• information provided is false or misleading;
• the account presents a fraud or safety risk;
• verification has failed;
• payment remains disputed or unpaid;
• the account has been compromised;
• continued access may expose another person or MarriageShadi.com to harm; or
• we are legally required to take action.

For serious safety, fraud or legal concerns, we may suspend or terminate an account immediately. Unless required by applicable law, members whose accounts are suspended or terminated because of a breach of these Terms are not entitled to a refund for unused membership time.

22. Intellectual Property

The MarriageShadi.com name, logo, website design, software, databases, graphics, text, trademarks and original platform content are owned by or licensed to us and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, sell, licence, reverse engineer or commercially exploit MarriageShadi.com without written permission.

23. Third-Party Services

MarriageShadi.com may use or link to third-party services, including payment providers, identity-verification providers, cloud-hosting providers, analytics providers, social login services and external websites. Third parties operate under their own terms and privacy policies. MarriageShadi.com is not responsible for independent third-party services, websites, availability, content or conduct.

24. Service Availability and Changes

We aim to provide a reliable service but cannot guarantee that MarriageShadi.com will always be uninterrupted, available or error-free. We may perform maintenance, correct technical problems, add, change or remove features, introduce new services, restrict access in certain locations, discontinue membership options or temporarily suspend services. Where required by consumer law, an appropriate remedy may be provided if a paid service cannot be delivered as required.

25. Disclaimers

MarriageShadi.com is provided on an "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted or error-free operation, that all members are verified, the accuracy of user-submitted information, a minimum number of suitable profiles, responses from other members, compatibility, an engagement or marriage, that every scam or misuse will be detected, that another member is trustworthy or safe, or that the platform will meet every user's expectations. Nothing in these Terms excludes any legal guarantee or right that cannot lawfully be excluded.

26. Limitation of Liability

To the fullest extent permitted by applicable law, MarriageShadi.com and its owners, directors, employees, contractors and service providers will not be liable for indirect, incidental, special, punitive or consequential loss arising from use of, or inability to use, the platform; the conduct of another member; inaccurate, incomplete or misleading profile information; unauthorised use of information by another member; lost opportunities; emotional distress; relationship or family disputes; loss of data; loss of profits or revenue; or third-party services.

Where our liability cannot legally be excluded but may be limited, our total combined liability arising from or relating to your membership, use of MarriageShadi.com or these Terms will not exceed the amount of one month's membership fee applicable to your membership at the time the claim arose. Where you are using a free membership, our total liability will not exceed the amount of the lowest-priced one-month paid membership available at the time the claim arose. This limitation does not apply to liability that cannot legally be excluded or limited under applicable law.

27. Indemnity

To the extent permitted by law, you agree to compensate MarriageShadi.com for reasonable losses, claims, liabilities or expenses resulting from your unlawful use of MarriageShadi.com, a serious breach of these Terms, content submitted by you, infringement of another person's rights, fraud or deliberate misconduct. You are not required to indemnify MarriageShadi.com for losses caused by our own unlawful conduct or liability that cannot legally be excluded.

28. Privacy

Our collection and use of personal information is governed by the MarriageShadi.com Privacy Policy. Matrimonial profiles may contain sensitive personal information. Information you choose to display may be visible to other registered members. You should review the Privacy Policy before creating an account or purchasing a membership.

29. Consumer Rights by Country

New Zealand

Where New Zealand law applies, nothing in these Terms excludes or limits rights available under applicable legislation, including the Consumer Guarantees Act 1993, the Fair Trading Act 1986 and the Privacy Act 2020. A change of mind does not automatically entitle a member to a refund, but remedies may apply where services do not meet mandatory legal guarantees.

European Union and European Economic Area

Consumers in the European Union or European Economic Area may have statutory cancellation, withdrawal and digital-service rights. Where legally permitted, by purchasing a membership and requesting immediate access to paid services, you request that the service begin immediately and acknowledge that this may affect any statutory cooling-off or withdrawal right. Nothing in these Terms removes mandatory rights relating to faulty or non-conforming digital services.

United Kingdom

UK consumers may have rights under applicable UK consumer laws, including the Consumer Rights Act 2015 and consumer contract regulations. Where legally permitted, requesting immediate access to paid services may affect statutory cancellation rights. Mandatory consumer rights cannot be excluded by these Terms.

Australia

Where the Australian Consumer Law applies, our services come with guarantees that cannot legally be excluded. You may be entitled to a remedy where services fail to comply with mandatory consumer guarantees.

Canada

Canadian consumers retain any rights that cannot be excluded under applicable federal or provincial consumer-protection laws.

United States

Consumer rights may vary by state. Nothing in these Terms excludes any rights or remedies that cannot legally be waived under applicable federal or state law.

Other Countries

Users in other countries retain any mandatory consumer rights that cannot legally be excluded by these Terms.

30. Governing Law

MarriageShadi.com is operated by a company registered in New Zealand. These Terms and Conditions are governed by and interpreted in accordance with the laws of New Zealand.

Subject to any mandatory consumer rights that apply in your country, the courts of New Zealand will have jurisdiction over disputes relating to these Terms and Conditions, your membership, payments made through MarriageShadi.com or your use of the platform. Nothing in this section prevents a consumer from bringing a claim in another jurisdiction where applicable law provides a mandatory right to do so. Nothing in these Terms excludes or limits any rights or remedies that cannot lawfully be excluded under New Zealand law.

31. Complaints and Dispute Resolution

If you have a complaint or dispute, please contact us first so we have a reasonable opportunity to investigate and resolve the issue.

Nothing in this section prevents you from contacting a consumer, privacy or regulatory authority or exercising any legal right available to you.

32. Changes to These Terms

We may update these Terms to reflect changes to our services, memberships, technology, security requirements, business operations or applicable laws. Updated Terms will be published on MarriageShadi.com with a revised "Last updated" date. Where legally required, we will provide reasonable notice of material changes. Your continued use of MarriageShadi.com after updated Terms take effect means you accept the updated Terms, unless further consent is required by law.

33. General Terms

Entire Agreement

These Terms, together with our Privacy Policy and any applicable checkout terms, form the agreement between you and MarriageShadi.com regarding use of the platform.

Severability

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

No Waiver

If we do not immediately enforce a provision of these Terms, this does not mean that we waive our right to enforce it later.

Assignment

You may not transfer your account or rights under these Terms without our written permission. MarriageShadi.com may transfer its rights and obligations as part of a legitimate business sale, restructuring or transfer, subject to applicable law.

Language

If these Terms are translated into another language, the English version will apply in the event of any inconsistency, to the extent permitted by law.
